Uninsured / Underinsured Motorist Claims

Helping Car Accident Victims with Insurance Claims

Getting hit by a car is a terrifying experience. Your shock might quickly turn to anger when you discover the negligent driver did not have insurance or carried too little coverage to pay for your medical expenses. You need to take immediate action so you do not get left holding the bag.

Bishop & Hayes, P.C. is an auto accident injury law firm with offices in Springfield, Joplin and Miami. With an exclusive focus on car accident cases, we have developed an intimate knowledge of even the most obscure auto accident-related laws and have refined our innovative approaches to recover the maximum possible damages.

By handling only auto accident claims, we have gained an in-depth understanding of insurance laws and can peel away the layers to maximize recovery in your uninsured or underinsured motorist accident claim. All cases are handled by one of our partners who have 50 years of combined experience in auto accident cases; your case is never passed to a paralegal or associate.

Recovery in Uninsured/Underinsured Cases in Missouri and Oklahoma

All drivers in Missouri and Oklahoma are required to carry at least $25,000 in bodily injury coverage per person and $50,000 of bodily injury coverage for all people injured in a single accident. Missouri requires $10,000 in property damage coverage while Oklahoma sets the minimum at $25,000. These coverage limits may sound high, but with skyrocketing medical costs, the minimum auto insurance coverage does not usually fully cover damages in serious car wrecks.

Missouri law requires uninsured motorist coverage in the same amounts, but you can carry a higher policy for an additional premium. You can also carry additional policies. In Oklahoma, insurance companies are required to offer the uninsured motorist coverage, but you can decline this coverage.

If the driver who ran into you was uninsured, our attorneys will pursue compensation from your insurance company. If your medical expenses exceed the amount of the negligent driver’s policies, our attorneys pursue the maximum coverage of the negligent driver and seek the remainder under your policy. We may also file a lawsuit against the driver to collect on a judgment for any amounts not covered by insurance.

To put as much money in your pocket as possible, our lawyers negotiate with doctors and hospitals for a reduction in medical bills. Our goal is to ensure that you receive the quality medical care you need without being saddled with debt for an accident you did not cause.

Hit-and-Run Accidents

Hit-and-run collisions are considered uninsured motorist claims. After all, you have no way to pursue damages from a driver who you cannot identify. Many drivers flee precisely because they are uninsured or unlicensed. So, even if police capture the hit-and-run driver, you face challenges to recover damages.
Our lawyers work closely with police and prosecutors to help you get justice and to maximize your monetary recovery.
